Today, our economy is truly global. Companies search all over the world in order to secure workers. The federal government has recognized this fact and has introduced many employment visas that enable foreign workers to live and work in the United States.

Employers and employees must meet a number of legal guidelines in order to secure the appropriate work visa. At Weisberg, Friedman & Klapisch, LLP, our lawyers assist employers with obtaining both permanent and temporary employment visas. Temporary employment visas fall into the following categories

  • E-1 visas are for treaty traders. E-2 visas are for treaty investors.
  • E-3 visas are for Australian nationals with an offer of employment.
  • H-1B visas are for workers in specialty occupations.
  • L-1 visas are for employees who have transferred within a company.
  • O visas are for persons of extraordinary ability (O-1), their assistants (O-2) and their dependents (O-3).
  • P visas are for artists, entertainers and athletes.
  • Q visas are for visitors under international cultural exchange programs.
  • R visas are for religious workers.
  • TN visas are for Canadian and Mexican workers working in a profession defined by the North American Free Trade Agreement (NAFTA).

Once we have determined the appropriate temporary employment visa for a prospective employee, we will help the employer prepare and file a Form I-129, or a Petition for Nonimmigrant Alien Worker with the USCIS. Once the petition is approved, the prospective employee can apply for the appropriate temporary visa, either at a U.S. Embassy or the appropriate U.S. Consular office. In many instances, employees may then obtain permanent residency through the labor certification process at some point after obtaining a temporary visa.
